HP is unveiling today the new tablet for business,the HP ElitePad 900 offers a 10.1-inch diagonal display, weighs just 1.5 pounds and measures 9.2 millimeters (mm) thin. The 16-by-10 aspect ratio maximizes the display area for ideal viewing of traditional business applications, as well as video content. Precision crafted, with an eye toward fit and finish, the HP ElitePad uses stylish, premium materials such as CNC-machined aluminum and Corning® Gorilla® Glass 2.

Powered by next-generation Intel® mobile processors (Atom-based Intel Clover Trail processor), buffered by up to 2GB of RAM and with Windows 8 in. On the back are two slots: one for microSD cards, and another for 3G / 4G SIMs.

The HP ElitePad tablet's 1080p front-facing video camera and 8 megapixel (MP) rear camera with an LED flash and included CyberLink YouCam software help users easily communicate face to face, create high-definition (HD) web videos or record training videos without high production costs.

Loaded with tools for mobile work or play
The HP ElitePad tablet's 1080p front-facing video camera and 8 megapixel (MP) rear camera with an LED flash and included CyberLink YouCam software help users easily communicate face to face, create high-definition (HD) web videos or record training videos without high production costs.


Powered by technology from HP Labs, the company's central research arm, new HP PageLift is an application that automatically trims, correctly lights and orients a captured image of a whiteboard, paper contract or other document so it is ready to use or share without requiring manual editing.

Users can easily print directly from their HP ElitePad to any ePrint-capable HP printer or to a networked HP printer without the need for downloading drivers. HP ePrint software allows users to print remotely at more than 24,000 public locations such as hotels and business service retailers. The HP ElitePad also helps small workgroups connect with HP Wireless Hotspot, a desktop application that allows users to share a wireless internet connection and network bandwidth.

Additional user-experience software includes the CyberLink Media suite, which enables users to manage and create audio and video content with the same easy-to-use interface as other HP business PCs. Plus, users can record and listen to audio with a stereo microphone and headset jack that feature the richness of SRS Audio.

Information management is made easy with Evernote, which captures, saves and synchronizes information across devices with impressively quick search capability, and Skitch software that eases collaboration with colleagues by quickly marking up images with captions or sketches.

Manageability, deployment and security for IT environments
The HP ElitePad offers a long life cycle, stable image and HP Global Series Support, all of which IT managers expect in an enterprise tablet. It also features a one-year standard warranty, with the option for a three-year warranty via HP Care Pack Services. The HP ElitePad is fully serviceable with an optional, industry-unique service tool for HP Self- Maintainers that allows customers to access the panel, battery, motherboard and unibody chassis, helping reduce downtime and keep sensitive data and devices in-house.


In addition, organizations will appreciate the enterprise-caliber data, device and identity protection from HP Client Security, including HP BIOS Protection, Security Manager and HP Drive Encryption. Additional security features include Device Access Manager, Computrace and Sparekey.

Device deployment and ongoing support and maintenance are made easy with x86 compatibility and support for HP Client Management solutions. The LANDesk Management Suite also increases security and eases management by providing exclusive tools to locate and protect data on lost devices, remotely capture SIM card info for mass WWAN activation and enforce geographic policies to remotely lock, full wipe or selectively wipe data

Availability
The HP ElitePad 900 is expected to be available in the United States in January 2013. Pricing information will be announced closer to availability.


This announcement follows HP's unveiling of touch-enabled notebooks on Aug. 30, all-in- one desktops on Sept. 10 and a new lineup of consumer and business PCs on Sept. 20.

 Google's Motorola Mobility unveiled its first smartphone handset to be powered by an Intel processor on Tuesday, featuring a wide screen and longer-life battery to better compete against Apple's iPhone and Samsung.


The Razr i will launch in Argentina, Brazil, Britain, France, Germany and Mexico in October, as the first handset of a multi-device agreement between the two groups.
With a 4.3-inch display and Google's Android platform, the Razr i is similar to the Razr M unveiled earlier in September for U.S. consumers, but its brain is an Intel processor instead of a chip made by Qualcomm.
Motorola's Andrew Morley, the general manager of Britain and Ireland, said the new chip enabled users to switch quickly between accessing the web, playing games, sending texts and activating the camera. The screen has virtually no border, so it also compares well in size to other rivals.
"This chipset gives us exactly what we want to launch in these markets," Morley told Reuters. "It gives us the ability to create a compact device, it gives us speed and it's a mid to high tier, mass market device.
Motorola says the battery is 40 percent more powerful than Apple's iPhone 4S and the camera can take 10 shots in under a second. There were no comparisons available with the new iPhone 5, which hits the shops later this month.
The new Motorola phone uses a new version of Intel's Medfield smartphone processor running at 2 Gigahertz, faster than the 1.6 GHz versions used in phones launched earlier this year by Orange in Britain, MegaFon in Russia and Lava International in India.

Its Super AMOLED Advanced 4.3-inch display spans from edge-to-edge with virtually no border - giving you more screen with less phone. RAZR i is the first smartphone that can achieve speeds of 2.0 GHz thanks to a fast Intel® Atom™ processor. Jump from a game to a text and over to a playlist, then off to browse the Web - all without stopping and on a long-lasting battery that is 40 percent more powerful than the competition.

IDF2012: Intel Labs tunes into a wireless future where everything that computes is connected.


NEWS HIGHLIGHTS
  • Intel Labs demonstrated the first all-digital WiFi radio integrated into the same chip with other digital building blocks that scales in size and energy efficiency to enable more things to connect to each other.
  • Featuring a new biometric identification technique, Intel Labs demonstrated how to eliminate passwords while making access to cloud-based services more secure.
  • WiGig, the newest WiFi standard, will dramatically reduce the number of wires and enable completely wireless docks and displays.
  • New technologies and collaborations with Verizon, China Mobile and Cisco to improve system efficiency while improving the overall user experience.


SAN FRANCISCO, Calif., Sep. 13, 2012 – In his keynote today at the Intel Developer Forum, Intel Chief Technology Officer Justin Rattner said, "In the future, if it computes, it connects. From the simplest embedded sensors to the most advanced cloud datacenters, we're looking at techniques to allow all of them to connect without wires."

Rattner demonstrated for the first time a working, all-digital WiFi radio, dubbed a "Moore's Law Radio." The CTO explained that an all-digital radio follows Moore's Law by scaling in area and energy efficiency with such digital chip processes as Intel's latest 22nm tri-gate technology. System-on-chip designs for smartphones and tablet computers would be the most likely spot for the all digital radios to be integrated. The small size and lower cost of integrated digital radios will enable a host of new applications from wearable devices to "The Internet of Things" where devices such as home appliances with sensors can communicate with each other, exchange data and can be operated remotely.

Rattner went on to describe a next-generation wireless standard called WiGig that operates in the millimeter wavelengths of the radio spectrum and delivers bandwidths well over 5 gigabits per second. The WiGig standard is an industry-wide effort to consolidate a number of proprietary 60 GHz wireless technologies under the existing WiFi standard.

"WiGig is so fast it will let you wirelessly dock your enabled Ultrabook™, tablet or smartphone without wires," said Rattner. "Even multiple displays can be docked at one time."

Delivering Convenience and Increasing Battery Life for Cloud Connected Devices
Users love the ability to receive email and social media updates while their devices are asleep. To bring this always on, always connected capability to the Ultrabook™ platform, Intel® Smart Connect technology currently wakes up the Ultrabook™ just long enough to receive the incoming packet traffic and then it goes back into standby mode to ensure long battery life.

Showing how the benefits of Smart Connect technology could be enhanced to include active operation for file transfer and video streaming, Rattner demonstrated "Spring Meadow," which manages communication between the cloud and the device more intelligently. By pre-processing incoming network traffic and proactively managing traffic flow, "Spring Meadow" makes more efficient use of the host processor, allowing it to remain in a low-power state longer without impacting system performance.

Eliminating Passwords, Increasing Security
Passwords remain the common, yet inconvenient way of protecting access to valuable or sensitive information. In an effort to eliminate the need for passwords, Intel Labs has developed a replacement scheme called Client Based Authentication Technology. Not only does it replace passwords, it dramatically simplifies and accelerates the process for accessing bank accounts, stock portfolios and other cloud-based personal information.

The technology allows the user to authenticate once to the physical device such as an Ultrabook™ or smartphone using a biometric sensor and then lets the device automatically authenticate itself with one or more cloud-based services. Reading a person's unique vein patterns in the palm of the hand, the user is then directly taken to his or her bank account, social network page or any kind of secure service. It also provides presence monitoring capability that locks the device and the secure service connection when the user puts his or her device down. A new biometric scan unlocks the platform and immediately restores the previous secure service connections. The whole process is virtually transparent, easy to use and more secure.

Cloud-Based Radio Access Networks, Future of Wireless Broadband
Rattner was joined onstage by Dr. Chih-Lin I, chief scientist at the China Mobile Research Institute in Beijing, to discuss the research collaboration between Intel Labs and China Mobile to design and prototype a full-scale Cloud Radio Access Network (C-RAN). C-Ran is an alternative to traditional RAN, which is the basis for modern cellular communications. Instead of simply moving the proprietary base station hardware to the data center, it is replaced by standard Intel-based servers running a software-defined radio application. Dr. I explained that C-RAN technology will dramatically reduce both capital and operational expenses for wireless service providers while providing superior levels of wireless services to users with fewer dropped connections during periods of peak demand.

Rattner described another research area, called a Video Aware Wireless Network (VAWN), where both service providers and end users will benefit from the latest wireless research. VAWN is the focus of a joint academic research program sponsored by Intel, Cisco and Verizon. With mobile video traffic expected to grow significantly over the next 5 years, according to Cisco Visual Networking Index, wireless networks could be constrained and video quality limited without new innovations. VAWN aims to increase the streaming video capacity of wireless networks while improving the viewing experience by optimizing network performance on an end-to-end basis.

Intel  refreshed mobile Celeron and Core i7 families.

The updated price list mentions 5 new mobile SKUs, including Celeron 887 and B830, Core i7-3740QM, i7-3840QM and i7-3940XM.

Three new Ivy Bridge mobile microprocessors are Core i7-3740QM, i7-3840QM and Core i7-3940XM Extreme. New CPUs replace Core i7-3720QM, i7-3820QM and i7-3920XM Extreme, that were available since this April. The 3x40QM/3940XM SKUs offer 100 MHz faster clock speed, while retaining all of the features of their predecessors.

 All three are quad-core processors with Hyper-Threading support, as such they can run up to 8 threads at once. The i7-3840QM and i7-3940XM have 8 MB L3 cache, and the 3740QM comes with smaller 6 MB last level cache. The flagship model, i7-3940XM, has unlocked clock multiplier. It also has the highest Thermal Design Power, 55 Watt as opposed to 45 Watt for the 3740QM and 3840QM CPUs. The official price of i7-3940XM is $1096. Core i7-3740QM and i7-3840QM are priced at $378 and $568.

Mobile Celeron 887 and B830 are faster versions of 877 and B820 SKUs. These Sandy Bridge chips have two CPU cores, clocked at 1.5 GHz and 1.8 GHz respectively. The processors integrate 2 MB L3 cache. Celeron 887 is an ultra low voltage part with 17 Watt TDP, and it's aimed at thin-and-light notebooks. The B830 is a mainstream CPU, and it has 35 Watt TDP. Both Celerons have the same official price, $86 in 1K tray quantities:

THIS CONTEST IS INTENDED FOR PLAY IN THE 50 UNITED STATES AND D.C. ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND LOCATED IN ONE OF THE 50 UNITED STATES OR D.C. AT THE TIME OF ENTRY.

HP + PROJECT RUNWAY CONTEST OFFICIAL RULES

1. NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. The HP + Project Runway Contest (“Contest”) is open and offered only to legal residents of the 50 United States and District of Columbia who are 18 years of age or older at the time of participating. Employees, officers and directors (and their immediate families [spouse, children, parents, siblings] and those living in their same households [whether or not related]) of The Hewlett-Packard Company (“Sponsor”), its parent, subsidiary, and affiliated companies, advertising, promotion, or production agencies and Web masters/suppliers (collectively “Promotion Parties”) are not eligible to participate. Void where prohibited. Subject to federal, state and local laws and regulations. Sponsor reserves the right, at any time, to verify eligibility requirements. By participating, entrants agree to these Official Rules, which are final and binding in all respects.

2. CONTEST TIMING: The Contest begins August 30, 2012 at 9:00:00 a.m. Pacific Daylight Time (“PDT”) and ends at 11:59:59 p.m. PDT on September 8, 2012 (the “Contest Entry Period”). Voting to determine the five (5) finalists will begin on September 13, 2012 at 9:00:00 a.m. PDT and ends on September 26, 2012 at 11:59:59 p.m. PDT. The computer clock of the Website is the official time-keeping device of the Contest.

3. CONTEST SUMMARY: Sponsor invites entrants to design a bag to hold an HP ENVY Ultrabook that is 37.4 cm (14.72") Width x 25.3 cm (9.95") Depth x 2 cm (0.78") Height. Each design must be an original work and cannot include any copyrighted elements (no logos, slogans, or art in use). Entrants may submit more than one (1) entry as defined in Rule #4. Submissions will be judged to determine forty (40) Semi-Finalists; then five (5) Finalists will be chosen by public voting and will advance to the final round of judging to determine the Grand Prize winner. See Rules 6, 7 and 8 for Judging Criteria and complete details on the winner determination process.

4. TO ENTER: Visit www.hp.com/projectrunway (the “Website”) and follow the online instructions to sign in using your Facebook or Twitter account. You will advance to the authorization page where you will be required to authorize Sponsor to pull your profile information and other content in order to participate in the Contest (“Sign In”). Next, follow the online instructions to input the name and a brief description of your design which must include measurements and manufacturing/production (up to 400 characters) and upload your photo, computer-aided design, or sketch (in a .jpg, .png, or .gif format at 800x600 pixels wide) of your Ultrabook case design (the “Entry”) and submit your Entry. Entries must be submitted in accordance to all of the Contest Entry Guidelines as specified herein and on the Website. Incomplete Entries and Entries including images in an invalid format/size will be void. Limit five (5) images per Entry; each image may show a different view of the case. Limit one (1) Entry per day. A “day” shall be defined as 12:00:00 a.m. PDT to 11:59:59 p.m. PDT of the same day except for the first day of the Contest Period and the first day of the Voting Period which is defined as beginning 12:00:00 p.m. PDT and ending 11:59:59 p.m. PDT of the same day. Each Entry must be unique and must not have been previously submitted during the Contest Entry Period. Entrants must agree to these Official Rules and Sponsor's terms of use and privacy policy.

Sponsor reserves the right to verify all Entries. If a dispute arises regarding the identity of an Entrant, the authorized account subscriber of the email account used at the time of entry will be considered the Entrant. “Authorized account subscriber” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address. Automated Entries are prohibited, and any use of such automated devices will cause disqualification. All Entries must be received during the Contest Entry Period. Please see the Sponsor's privacy policy at http://welcome.hp.com/country/us/en/privacy.htmlfor details regarding the personal information collected in connection with this Contest. By entering this Contest you consent to Sponsor and its promotional agencies storing and using the personal information you submitted with your Entry for the purpose of administering the Contest. Finalists will be included in a publicly-available winner’s list.

5. CONTEST ENTRY GUIDELINES: By submitting an Entry you warrant and represent that it: (a) is your original work, (b) has not been previously published, (c) has not previously won awards, (d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (e) that you have obtained permission from a person whose name or likeness is used in the Entry and (f) that publication of the Entry via various media including Web posting, will not infringe on the rights of any third party rights. Any such Entrant will indemnify and hold harmless, Sponsor from any claims to the contrary. The Entry must meet the following guidelines:
  • Entries must comply with these Official Rules and any Terms of Service on the Website;
  • Entry cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain nudity or any materially-dangerous activity;
  • Entry cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message;
  • Entry cannot be obscene or offensive, endorse any form of hate or hate group;
  • Entry cannot defame, misrepresent or contain disparaging remarks about Sponsor or its products, or other people, products or companies;
  • Entry cannot contain trademarks, logos or trade dress owned by others (except trademarks, logos or trade dress owned by Sponsor), or advertise or promote any brand or product of any kind (except for brands or products owned by Sponsor), without permission, or contain any personal identification, such as license plate numbers, personal names, email addresses or street addresses;
  • Entry cannot contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in Website, television, movies or other media) without permission. Sponsor does not permit the infringement of others’ rights and any use of materials not original to the Entrant (except copyrighted materials owned by Sponsor) is grounds for disqualification from the Contest. Do not copy your favorite movie, book or photo or include materials, images, graphics, music or trademarks belonging to any third parties or incorporate the names, voices, likeness or personas of any party other than yourself unless you have obtained all rights necessary to permit you to use same in connection with your Entry and grant the rights herein granted to Sponsor;
  • No background artwork should appear in an Entry unless it is an original work of the Entrant. Any artwork, murals, etc. that can be seen in Entries must be created solely by the Entrant or Entrant must be the sole owner of all copyright interests therein;
  • Entry cannot contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without permission;
  • Entry cannot communicate messages or images inconsistent with the positive image and/or goodwill to which Sponsor wishes to associate; and
  • Entry cannot depict, and cannot itself, be in violation of any law.

Any waiver of any Entrant obligation hereunder by Sponsor does not constitute a general waiver of Entrant obligations. Sponsor reserves the right to waive the Contest entry requirements set forth herein in its reasonable discretion. Sponsor reserves the right, in its reasonable discretion, to request that any Entrant resubmit his or her Entry which fails to comply with the Entry requirements prior to the end of the Contest Entry Period. Sponsor reserves the right to, and may or may not, monitor/screen entries prior to posting them to the Website. By entering, you acknowledge that Sponsor has no obligation to use or post any Entry you submit.

6. CONTEST JUDGING-ROUND ONE (to determine forty [40] Semi-Finalists): Entries will be judged by a Sponsor-selected panel of judges (“Judges”) based on the following criteria (“Judging Criteria”):

(a) Innovation and Originality. Is the bag design offering something new and original? Does it significantly improve the experience of toting around and/or using a laptop?
(b) Aesthetics and Style. Are the submitted images polished? Convincing? Stylish? Would consumers buy this bag based on the submitted imagery?
(c) Appropriateness for the HP Ultrabook Envy. The HP Ultrabook Envy is unique in the way it combines affordability with light-weight, sleek, effortlessly mobile design. Does the submitted bag design fit with the HP Ultrabook in being sleek, stylish, lightweight, small, portable?
(d) Thoughtfulness and attention to detail. Is there an interesting idea behind this laptop bag design? Has the design been clearly thought-through?
(e) Practicality and Marketability. Did entrant's Description include a brief description of the production/manufacturing process?
(f) Following Directions. Did the entrant submit a Description, measurements, specifications and production details for their bag design? Does the size of the bag correspond appropriately to the size of the HP Ultrabook? Are the Description and images clear and organized?

For each judging criterion, judges will award points on a 0-5 point scale, with 5 being the highest point score and 0 being the worst score. At the conclusion of the judging, the forty (40) Entries receiving the highest cumulative point scores for all Judging Criteria awarded by the Judges will be deemed the Semi-Finalist Entries. In the event of a tie, tie breaker will be based upon the highest point score in the first Judging Criteria, continuing thereafter to each Judging Criterion in order, as needed, to break the tie. Semi-Finalist Entries will be determined on or about September 12, 2012.

7. VOTING (to determine five [5] finalists): During the Voting Period, Semi-Finalist Entries will be posted at www.hp.com/projectrunway. To vote, you must first Sign In as described in Rule #4. Upon completing the Sign In process, you will then be able to vote for the Entry you think is innovative, creative and aesthetically pleasing. Limit of one (1) vote per Entry per day. Any use of robotic, macro, automatic, programmed or like voting methods will void all such votes. Any attempt by an Entrant and/or his/her respective family/friends to vote more than the number of times authorized herein using multiple names or e-mail addresses, paying or retaining third parties to create Facebook or Twitter accounts for the purposes of voting and/or any other fraudulent mechanism, as determined by Sponsor in its sole discretion, shall give Sponsor the right to disqualify such Entrant in its reasonable discretion. Any attempt by any person to fraudulently circumvent the voting restrictions in order to cast multiple votes will result in disqualification of all such votes received and may result in disqualification of the Entrants for whom the improper votes were received if the Sponsor determines that that Entrant was involved in any way in the perpetration of such fraud. At the conclusion of the Voting Period, the top five (5) Entrants, whose Entries receive the highest number of votes will be deemed Finalists (subject to verification) and will advance to the Final Round of Contest Judging. In the event of a tie, tied entrants will be included in the Final Round of Contest Judging. Limit one (1) Finalist Entry per person. Finalists will be determined and announced on the Website on or about September 27, 2012.

8. CONTEST JUDGING-FINAL ROUND (to determine Grand Prize Winner): Finalist Entries will be judged by the Judges based on the Judging Criteria described in Rule #6. The Entrant whose Entry receives the highest cumulative point score for all Judging Criteria awarded by the Judges will be deemed the Grand Prize winner. In the event of a tie, tie breaker will be based upon the highest point score in the first Judging Criteria, continuing thereafter to each Judging Criteria in order, as needed, to break the tie. Grand Prize winner will be determined on or about October 15, 2012.

9. PRIZES: Grand Prize (1): Ten thousand dollars ($10,000) awarded in the form of a check or wire transfer, payable to winner. Approximate Retail Value (“ARV”): $10,000.Finalist Prizes (5): One (1) HP Envy Spectre XT 13t-2000. ARV: $999. Winners must accept prize as stated, or prize may be forfeited and awarded to an alternate winners. Total ARV of all prizes: $10,999. Taxes, if any, on prizes are the sole responsibility of the winner. The difference between any stated prize value and actual prize value will not be awarded. Winners will be issued an IRS 1099 form for the retail value of their prize. Winners will be solely responsible for any fees or costs associated with the prizes they receive, regardless of whether it, in whole or in part, is used. The ARV of the Finalist Prize is based on available information provided to Sponsor and the value of any prize awarded to a winner may be reported for tax purposes where required by law. Prizes cannot be transferred, redeemed for cash or substituted, but Sponsor reserves the right to substitute a prize of equal or greater value at its sole discretion. Limit one (1) Finalist Prize per person/address/household. Unclaimed prizes will not be awarded.

10. WINNER NOTIFICATION: Finalists will be required to complete, sign and return an Affidavit of Eligibility and a Liability Release within seven (7) days of receipt of notification, as determined by Sponsor, in Sponsor's sole discretion. Grand Prize winner will be required to complete, sign and return an Affidavit of Eligibility and a Liability Release within seven (7) days of receipt of notification, as determined by Sponsor, in Sponsor's sole discretion. If documents are not returned timely, or if the prize notification or prize is returned as nondeliverable, or if Finalist/Grand Prize winner is found to be ineligible or otherwise not in compliance with these Official Rules, prize may be forfeited and an alternate Finalist or Grand Prize winner may be selected. In the event that a potential Finalist or Grand Prize winner is disqualified for any reason, Sponsor reserves the right to award the prize to an alternate Finalist or Grand Prize winner even if the disqualified potential Finalist's/Grand Prize winner's name(s) may have been announced. A prize recipient who is a minor in his/her state of residence will be awarded to minor’s parent or legal guardian who must sign and return all required documentation. Sponsor is not responsible for any change of email, mailing address and/or telephone number of Entrants.

11. GENERAL CONDITIONS: As a condition of entering, Entrants (or their parent or legal guardian if an eligible minor) agree (and agree to confirm in writing) that: (a) Sponsor, Promotion Parties, and all of their respective officers, directors, employees, representatives and agents (collectively “Released Parties”) are released, will have no liability whatsoever for, and shall be indemnified and held harmless by participants against any liability for any injuries, losses or damages of any kind to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in this Contest or any Contest-related activities. Except where legally prohibited, Finalists grant (and agree to confirm this grant in writing) permission to Sponsor and those acting under its authority the right to the use of his/her name, picture, likeness, voice, biographical information and statements, at any time or times, for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval.

BY SUBMITTING AN ENTRY, ENTRANT ACKNOWLEDGES THAT HIS/HER ENTRY MAY BE POSTED ON SPONSOR’S WEBSITE, IN SPONSOR’S DISCRETION. Submission of an Entry grants Sponsor and its agents an unlimited, worldwide, perpetual, license and right to publish, use, publicly perform the Entry in any way, in any and all media, without limitation, and without consideration to the Entrant. By submitting an Entry, you agree that your submission is gratuitous and made without restriction, will not place Sponsor under any obligation, Sponsor is free to disclose or otherwise use the ideas contained in the Entry on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your Entry, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than you.

By accepting a prize, the Entrant agrees that his/her Entry will be deemed a Work Made For Hire under the Copyright laws of the United States, but if it cannot be so deemed, then the winner irrevocably assigns and transfers to Sponsor all of his/her right, title and interest in and to his/her Entry, including all but not limited to all copyright and trademark rights which he or she may have, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. Winner hereby waives in favor of Sponsor, all rights of “Droit Moral” or “Moral Rights of Authors” or any similar rights or principles of law that winner may now or later have to his/her Entry. Sponsor reserves the right to alter, change or modify the winning Entry, in its sole discretion. Upon request of Sponsor, Entrant shall execute and deliver such additional instrument of assignment, as may be solely deemed by Sponsor, reasonably necessary to establish the ownership of record of the right, title and interest in and to the Entry and of the copyrights transferred and “Moral Rights of Authors” waived under these Official Rules. Should Sponsor fail to request the said assignment as stated, that shall not be deemed a waiver of Sponsor’s rights and Sponsor may at a later time request the assignment.

12. LIMITATIONS OF LIABILITY: Neither Sponsor, Released Parties nor their agencies are responsible for lost, illegible, late, misdirected, incomplete, mutilated, or non-delivered Entries, emails, votes; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, garbled, corrupted, scrambled, delayed or misdirected transmissions, or computer hardware or software or telephone malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information, or the failure to capture, or loss of, any such information. Sponsor, Released Parties and their agencies are not responsible for any incorrect or inaccurate information, whether caused by users of the Website, or by any equipment or programming associated with or utilized in this Contest; and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the Website. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry or voting process or operation of the Contest or Website, to be acting in violation of the terms of the Website or to be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Sponsor, Released Parties and their agencies are not responsible for injury or damage to participant, participant's computer or any other person’s computer related to or resulting from participating in this Contest or downloading or copying materials from or use of Website. If, for any reason, Contest, in the sole opinion of Sponsor, is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes which, in sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend Contest, and determine the Winning Entry from eligible Entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor. If such malfunction, error, disruption or damage occurs, and impairs the administration, security, fairness, integrity or proper play of the Contest, Sponsor may, in its sole discretion, suspend or terminate the Contest by posting a notice on the Website.

In no event will Sponsor, Released Parties, or their respective parents, affiliates, subsidiaries and related companies, their advertising or promotion agencies or all of their respective officers, directors, employees, representatives and agents be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and use of the Website or downloading from and/or printing material downloaded from said Website. Without limiting the foregoing, everything on the Website is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow limitations of exclusion of liability for incidental or consequential damages or exclusion of implied warranties, so some of the above limitations or exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding these limitations or exclusions. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT AS PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.

13. BINDING ARBITRATION: Any controversy or claim arising out of or relating to this Contest shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply California law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law. In the event that the claimant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the claimant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, the portion that is deemed invalid, unenforceable or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties. THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE ENTRANT’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS CONTEST IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES. BY PARTICIPATING IN SPONSOR’S CONTEST, EACH ENTRANT AND PRIZE WINNER AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY THROUGH BINDING ARBITRATION AS SET FORTH ABOVE, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT OR PRIZE RECIPIENT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANT AND PRIZE WINNER'S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO EVERY ENTRANT.

14. GOVERNING LAW/JURISDICTION: By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of State of California, USA, without giving effect to any choice of law or conflict of law rules, and any matters or proceedings which are not subject to arbitration as set forth in these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of California, in Santa Clara County, California. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Santa Clara County, California, USA.
